LIVE UPDATES | Minneapolis shooting: Border Patrol fatally shoots man

MINNEAPOLIS (FOX 9) - Federal Border Patrol agents fatally shot a Minneapolis man Saturday morning. This is the third shooting involving federal agents since Renee Good was fatally shot by an ICE agent on Jan. 7. 

Federal authorities say the man who was shot was armed. Border Patrol Commander Greg Bovino did not state if the man pulled a gun or where the gun was when he was shot. The man had a legal permit to carry, is a U.S. citizen and lives in Minneapolis, according to Minneapolis Police Chief Brian O'Hara.

Protesters have gathered at the scene of Saturday's shooting. Chemical irritants are being used on the large crowds. Minneapolis Police Chief Brian O'Hara called the protest an unlawful assembly. 

The shooting comes the day after thousands of Minnesotans took to the streets in subzero temperatures for a peaceful march and rally calling on ICE to leave the state.

2:13 p.m. - Twins Fest shutting down after Minneapolis shooting

Twins Fest will be shutting down Saturday afternoon following the fatal shooting of a protester in Minneapolis.

2:10 p.m. - Minnesota National Guard will assist local police

The Minnesota National Guard will assist local police during the ongoing protest following the second fatal shooting during Operation Metro Surge. 

2:05 p.m. - Crowd mostly peaceful near shooting scene

The scene of the shooting has turned mostly peaceful after chemical irritants were used on the crowd earlier in the day. The crowd does continue to grow. 

2 p.m. - Timberwolves game scheduled for Saturday postponed

The Timberwolves-Warriors game scheduled for Saturday at 4:30 p.m. has been postponed following the shooting. 

1:54 p.m. - Man killed by Border Patrol identified as Alex Pretti

The man who was fatally shot by Border Patrol was ICU nurse Alex Pretti, The Associated Press said after speaking with the man's parents. 

1:50 p.m. - BCA investigating

According to the Minnesota BCA: 

"The BCA Force Investigations Unit has been requested by Minneapolis police to investigate this morning’s federal agent-involved shooting in Minneapolis. Our agents and crime scene personnel attempted to access the location but were blocked by DHS personnel at the scene."

1:34 p.m. - Walz speaks on Minneapolis fatal shooting

Walz said this federal operation in Minnesota stopped being about law enforcement. He's watched the videos of the shooting, calling it "sickening." He said the man who was shot is a lawful firearm carrier.

"Minnesota's justice system will have the last word on this. It must have the last word. As I told the White House in no uncertain terms this morning, the federal government cannot be trusted to lead this investigation. The state will handle it," Walz said. 

Walz said Minnesotans have done what they can to de-escalate the situation. 

"We want calm, peace and normalcy back to our lives. They want chaos," Walz said. He added, "We want calm and peace and normalcy back to our lives. They want chaos. We cannot and we will not give them what they want by meeting violence with violence."

Walz called on President Donald Trump to remove the force in Minnesota, saying "they are sowing chaos and violence."

Bob Jacobson, commissioner of Public Safety, called for peaceful demonstrations. 

1:30 p.m. - President Trump statement

President Donald Trump posted about the shooting on social media. He said:

"This is the gunman’s gun, loaded (with two additional full magazines!), and ready to go – What is that all about? Where are the local Police? Why weren’t they allowed to protect ICE Officers? The Mayor and the Governor called them off? It is stated that many of these Police were not allowed to do their job, that ICE had to protect themselves — Not an easy thing to do! Why does Ilhan Omar have $34 Million Dollars in her account? And where are the Tens of Billions of Dollars that have been stolen from the once Great State of Minnesota? We are there because of massive Monetary Fraud, with Billions of Dollars missing, and Illegal Criminals that were allowed to infiltrate the State through the Democrats’ Open Border Policy. We want the money back, and we want it back, NOW. Those Fraudsters who stole the money are going to jail, where they belong! This is no different than a really big Bank Robbery. 1:09 p.m. - Federal officials on Minneapolis shooting, ICE operations

Border Patrol Commander Greg Bovino says federal law enforcement has been "under attack" in Minneapolis. Bovino said officers fired "defensive shots" at the man, who was armed. 

The officer who shot the man has been with the Border Patrol for eight years. 

The shooting is under investigation, Bovino said. It's unclear if the man who was shot pulled a gun.

1 p.m. - House GOP on Minneapolis shooting

House Speaker Lisa Demuth (R-Cold Spring) and Republican Floor Leader Harry Niska (R-Ramsey) released the following statements today:

"Today we had another tragic loss of life, and I am heartbroken for the loved ones affected," said Speaker Demuth. "As we saw yesterday, thousands of Minnesotans were able to peacefully demonstrate without a single incident. Unfortunately there are still too many political leaders urging direct confrontation including the attempted disruption of law enforcement operations and throwing of dangerous objects. These dangerous tactics put lives of officers and the public at risk. We can have protest. We can have lawful monitoring of ongoing law enforcement operations. But it’s going to take leadership at all levels of government to turn down the temperature. I spoke earlier this week with Vice President Vance, who expressed both publicly and privately a sincere desire to foster better cooperation between the federal government and state and local officials."

Leader Niska added:

"Escalation, violent rhetoric, and demonization has put the lives of Minnesotans and law enforcement alike in danger. It’s time to work together to remove violent criminals from our communities and ensure the safety of all Minnesotans. Knee-jerk reactions demanding confrontation instead of cooperation are putting everyone at risk. Minnesotans know how to exercise their constitutional right to peacefully protest and make their voices heard. It’s time to display real leadership and act in the best interests of all Minnesotans."

12:47 p.m. - House DFL leader on Minneapolis shooting

Rep. Zack Stephenson released the following statement:

"Another Minnesotan is dead at the hands of federal agents. And why? How many people must die before Donald Trump’s drive for ‘retribution’ is satisfied? The people of Minnesota, from five-year-old children to barely clothed elders, have suffered more than enough."

"ICE must leave Minnesota now. Full stop."

"The federal government lacks the credibility to investigate this matter. The BCA must be allowed to investigate, and anyone who broke Minnesota law must be held accountable. No ‘absolute immunity.’ No lies. Justice and peace. Now."

12:27 p.m - ICE Minneapolis protests: Chemical irritants used on crowd

Chemical irritants are being used on crowds after Border Patrol agents fatally shot a Minneapolis man on Saturday morning. FOX 9's Kelly O'Connell had to run from chemical irritants as they were used on the crowd. 

12:20 p.m. - ACLU demands action after Saturday shooting

"Yesterday tens of thousands of Minnesotans from all walks of life marched through the streets in subzero temperatures to demand ICE stop terrorizing our communities, and today we wake up to the heartbreaking news that federal officials killed another person. ," said Deepinder Mayell, executive director of ACLU of Minnesota. "This tragedy is further proof that these federal agents are out of control and critically endangering our communities. ICE and CBP must end their operations in our city before anyone else is harmed, and an independent investigation must be conducted."

"After the horrific shooting of Renee Good, the Trump administration recklessly escalated and deployed even more heavily armed agents into Minneapolis, and, today, we are again seeing the devastating and predictable consequences," said Naureen Shah, director of immigration policy and government affairs at ACLU. "Congress must rein ICE in before what happened in Minneapolis happens yet again. Senators must reject a DHS budget that allows these lawless agencies to continue putting our communities in danger."

12:10 p.m. - Rep. Omar's statement on Border Patrol shooting

Rep. Ilhan Omar (D-Minnesota) issued the following statement following the reporting that immigration enforcement killed another Minnesota resident:

"This appears to be an execution by immigration enforcement. I am absolutely heartbroken, horrified, and appalled that federal agents murdered another member of our community. It is beyond shameful these federal agents are targeting our residents instead of protecting them. 

"This isn’t isolated or accidental. The Trump administration is trying to beat us into submission rather than protect us. This administration cannot continue violating constitutional rights under the guise of immigration enforcement. ICE and CBP must leave Minnesota immediately. Their presence is terrorizing our communities, violating rights, and taking lives with zero accountability. Minnesota was once a place of refuge, and Trump has turned it into a war zone where unchecked federal forces murder our neighbors."

Noon - Walz releases another statement

Gov. Tim Walz on social media said, "I told the White House the state must lead the investigation. Let state investigators secure justice. As we process the scene, stay peaceful and give them space. The State has the personnel to keep people safe – federal agents must not obstruct our ability to do so."

11:57 a.m. - Frey on shooting

Frey, at a press conference on Saturday morning, said, "I just saw a video of more than six masked agents pummeling one of our constituents and shooting him to death. How many more residents? How many more Americans need to die or get badly hurt for this operation to end?"

Frey called on the ICE operation to end. 

"I'm done being told that our community members are responsible for the vitriol in our streets. I'm done being told that our local elected officials are solely responsible for turning down the temperature. Just yesterday, we saw 15,000 people peacefully protesting in the streets, speaking out, standing up for their neighbors. Not a single broken window, not a single injury," Frey said. 

11:51 a.m. - MPD Chief O'Hara on shooting

At about 9:03 a.m. Minneapolis police received a report of a shooting by federal officials, Minneapolis Police Chief Brian O'Hara said. Officers arrived and found a man with multiple gunshot wounds. He was taken to the hospital, where he was pronounced dead. 

O'Hara said he's a 37-year-old white man, a Minneapolis resident. They believe he's an American citizen. He is a lawful gun owner with a permit to carry.

O'Hara believes more than one law enforcement officer fired their weapons.

O'Hara said they have not been told official reports of what led to the shooting, but he has seen the video. 

"Our demand today is for those federal agencies that are operating in our city to do so with the same discipline, humanity and integrity that effective law enforcement in this country demands," O'Hara said. 

O'Hara is urging everyone to remain peacefully, recognizing there's a lot of anger and questions about what happened. There is an unlawful assembly at this time, and Minneapolis police have given warnings to the crowd to disperse. 

"We are asking for people to avoid the area and to leave. If you are there. We have requested mutual aid from the Minnesota State Patrol and from all our local and county regional partners. We ask everyone to remain calm and to please do not destroy our own city," O'Hara said. 

11:48 a.m. - Chemical irritants used on crowd

Chemical irritants are being used on protesters at the scene. Protesters have blocked the streets with dumpsters. 

11:45 a.m. - Border Patrol union statement

In a statement on social media, Border Patrol Union says: 

"Border Patrol agents are trained extremely well to protect themselves, their fellow agents, and innocent third parties. When a supposed "peaceful" protester brings a weapon (such as a loaded handgun) and brandishes it, there are going to severe consequences and repercussions. We have pleaded with and warned the media and the politicians that their irresponsible, hate-filled and false rhetoric is going to get people unnecessarily hurt, or worse, killed when they portray our agents and officers as the aggressors. They have encouraged these reckless confrontations and attacks on our agents and officers who are performing their lawful duties and enforcing the laws that Congress has put on the books. The fake and dishonest media and the shameless politicians should be held accountable for willfully misleading the public and enticing these protesters and agitators. We have full confidence that when more facts are revealed, our agents and officers will be shown to have utilized justifiable force in eliminating the threat."

11:35 a.m. - Sen. Klobuchar: ‘Get ICE out of Minnesota now’

Sen. Amy Klobuchar tweeted Saturday morning, "Donald Trump and all your lieutenants who ordered this ICE surge: watch the horrific video of the killing today. The world is watching. Thousands of citizens stopped and harassed. Local police no longer able to do their work. Kids hiding. Schools closed. Get ICE out of Minnesota NOW. And Republicans in congress: Stop your silence and stop being complicit."

11:32 a.m. - DHS statement on shooting

DHS released a statement on the shooting on social media. Here's what DHS claims happened: 

"At 9:05 a.m. CT, as DHS law enforcement officers were conducting a targeted operation in Minneapolis against an illegal alien wanted for violent assault, an individual approached US Border Patrol officers with a 9 mm semi-automatic handgun," the post says. "The officers attempted to disarm the suspect but the armed suspect violently resisted. More details on the armed struggle are forthcoming. 

"Fearing for his life and the lives and safety of fellow officers, an agent fired defensive shots. Medics on scene immediately delivered medical aid to the subject but was pronounced dead at the scene. The suspect also had 2 magazines and no ID—this looks like a situation where an individual wanted to do maximum damage and massacre law enforcement. 

"About 200 rioters arrived at the scene and began to obstruct and assault law enforcement on the scene, crowd control measures were deployed for the safety of the public and law enforcement.  This situation is evolving, and more information is forthcoming."

11:28 a.m. - Another protester taken to the ground 

Another protester was taken to the ground by law enforcement during a protest following the fatal shooting of a man. 

11:16 a.m. - Fire in dumpster at shooting scene

There is a dumpster on fire near the scene of the shooting. Protesters appear to be using dumpsters to block the street near the shooting scene. 

11:11 a.m. - Man detained at shooting scene during protest

A man was detained by federal officials during protests following the fatal shooting of a man by federal agents Saturday morning. 

10:58 a.m. - Chemical irritant deployed

A chemical irritant was deployed at the scene of the shooting where protesters were gathered. 

10:52 a.m. - FOX 9 sources say person has died

Sources told FOX 9 the man who was shot has died. He was reportedly shot in the chest. 

10:51 a.m. - HCAO statement 

Hennepin County Attorney Mary Moriarty released the following statement: 

"We are aware of reports of a federal agent having shot an individual in Minneapolis this morning. We are working with the Bureau of Criminal Apprehension to coordinate a state response.

The scene must be secured by local law enforcement for the collection and preservation of evidence. We expect the federal government to allow the BCA to process the scene."

10:50 a.m. - City of Minneapolis to give media briefing

According to a press release from the City of Minneapolis, there is a media briefing at 11:30 a.m. on the shooting. 

Here's the release: "Mayor Jacob Frey, Police Chief Brian O’Hara, Director of Emergency Management Rachel Sayre will hold a media briefing to discuss the shooting of an adult male in Minneapolis involving ICE agents.

"Mayor Frey is again demanding that ICE leave the city and state immediately. We stand by our immigrant and refugee communities – know that you have our full support. 

"We urge the public to remain calm, follow the City of Minneapolis social media accounts, and visit our website for up-to-date information on how the Cit is responding to federal immigration enforcement."

10:45 a.m. - Rally planned at scene of Saturday shooting

A vigil and rally are being organized at the scene of Saturday's shooting. It's scheduled for 1 p.m at East 26th Street and Nicollet Avenue South.
